Legal basis, use and protection of data
Informational use of the website
When you visit our website for informational reasons, i.e. without registering for any of our provided services and without providing us with personal data in any other form, we may automatically collect additional information about you which will contain personal data only in limited cases and which is automatically recognized by our server. Certain information is collected by most browsers or automatically through your device, such as your Media Access Control (MAC) address, computer type (Windows or Macintosh), screen resolution, operating system name and version, device manufacturer and model, language, Internet browser type and version, and the name and version of the Sites (such as the Apps) you are using. We use such information only to assist us in providing an effective service (e.g. to adapt our website to the needs of your end user device or to allow you to log in to our website), and to collect broad demographic information for anonymized, aggregate use. Our website offers a Customer Portal. In order to use the Customer Portal you have to set up an account. In relation to the registration of an account and its subsequent use, we process your email address, first name, last name, gender, language preference, organization name and password. We will process the personal data you provide to identify you at sign-up, to process your enquiries, to carry out online communications and collaboration (e.g. via Microsoft Teams) or to provide you with access to certain information. Planon offers a demo environment for Planon Apps and Planon Mobile Field Services. In order to use the Planon Apps you have to set up an account. Regarding the registration of an account and its subsequent use, we process your email address, first name, last name, organization name, and password. We will process the personal data you provide to identify you at sign-up, to process your enquiries, to carry out online communications, or to provide you with access to certain information. For this, the legal basis is Article 6 sec. 1 sent. 1 lit. b GDPR.
Contacting us/Customer Service
If you contact us - e.g. via e-mail or via a contact form available on our website - your personal data will be stored and processed by us. This is normally your name and your e-mail address as well as the additional information you provide. This data is stored and used to respond to your request and/or for the establishment of contact and the associated technical administration and/or for contacting you for a (new) opportunity. The legal basis is Article 6 sec. 1 sent. 1 lit. b GDPR insofar as it is carried out to fulfil a contract or pre-contractual measures, and Article 6 sec. 1 sent. 1 lit. f GDPR, as the processing of these requests is in the interest of both parties.
For some of our services, it is necessary to give your consent for the saving and processing of certain personal data. We share your personal data within the Planon Group, please see above listing, and, if applicable, share your personal data with a country specific reseller/partner. The data is transferred for the purpose of answering your request and/or for the establishment of contact and the associated technical administration and/or for contacting you for a (new) opportunity and/or to inform you about new Planon product offers and other relevant information, e.g. general (news) articles about facility management and real estate management.
We may disclose your personal data to contractors who assist us in providing the services we offer to you: Marketing Automation Systems (like Marketo, InsideView), Customer Relationship Management Systems (like Salesforce, Showpad (for Showpad we also apply these use and privacy terms)), Web traffic analytics (like Google, VWO, Modx, Moz). Advertisement Platforms (like Bing Ads, Google Ads, Facebook, LinkedIn, Xing Ads), HR Vacancy Systems (like Talentsoft).
Such a transfer will be based on data processing agreements in accordance with Article 28 sec. 3 GDPR. Therefore, our contractors will only use your personal data to the extent necessary to perform their functions and will be contractually bound to process your personal data only on our behalf and in compliance with our requests.
Cross boarder transfers
Within the scope of our information sharing activities set out above, your personal data may be transferred to other countries, including those outside the European Union and the European Economic Area, which may have different data protection standards than your country of residence. The transfer of data beyond national borders is merely for data storage and back-up. All transfers are in strict compliance with the applicable data protection regulations and adhere to data security requirements. Planon Corp commits to cooperate with EU data protection authorities (DPAs) and the Swiss Federal Data Protection and Information Commissioner (FDPIC) and comply with the advice given by such authorities with regard to human resources data transferred from the EU, the United Kingdom and Switzerland in the context of the employment relationship.
